Welcome to El Bombero USA. These Terms & Conditions (“Terms”) govern your use of elbomberousa.com (the “Site”) and any purchase you make through it. By visiting the Site or placing an order, you agree to these Terms, along with our Privacy Policy, Shipping Policy, and Return Policy, which are part of these Terms. If you do not agree, please do not use the Site.

1. You must be 21 or older

El Bombero USA sells cigars and cigar-related products. Tobacco products may only be sold to adults. By using the Site or placing an order, you confirm that you are at least 21 years of age (or the minimum legal age for purchasing tobacco where you live, if higher) and that the person receiving the delivery will also be 21 or older.

We use age verification at checkout and may require a valid government-issued photo ID before releasing an order. Deliveries containing tobacco may require an adult signature. We reserve the right to cancel and refund any order if we are unable to verify your age or believe the order was placed by or for a minor.

2. Products

The El Bombero Firefighter Call Box Collector’s Edition is a limited-edition collector’s piece that ships as a complete set with cigars inside. We also offer cigar accessories, including the Tabletop Cigar Cutter, Waterproof Cigar Travel Case, Limited-Edition Challenge Coin, and Cigar Accessory Gift Set.

We do our best to display products accurately, but colors, finishes, and details may vary slightly from what appears on your screen, and handcrafted pieces may have minor variations. Limited-edition items are available only while supplies last, and we may limit quantities per customer, per order, or per household.

3. Orders, pricing, and payment

All prices are in U.S. dollars and do not include applicable sales, excise, or tobacco taxes, or shipping charges, which are added at checkout where required. Orders must be paid in full before they ship. We reserve the right to correct pricing or product errors, to refuse or cancel any order, and to cancel orders that appear to be placed for resale or by automated means. If we cancel an order after you have paid, we will refund the amount charged.

Placing an order is an offer to purchase. Your order is accepted when we send a shipping confirmation. An order confirmation email means we have received your order, not that it has been accepted.

4. Shipping and delivery

Shipping timelines, tracking, carrier requirements, and what to do if a package arrives damaged are covered in our Shipping Policy. Products containing tobacco can only be shipped to addresses within the United States where such shipments are permitted. We do not ship to P.O. boxes or to states or localities where the sale or shipment of these products is prohibited, and we may cancel and refund orders to those destinations. You are responsible for knowing and complying with the laws of the place where you receive your order, including any taxes owed there.

5. Returns and refunds

Cigars and the Firefighter Call Box Collector’s Edition are final sale. Accessories may be returned within 30 days of delivery if unused and in their original packaging. Items that arrive damaged, defective, or incorrect will be replaced or refunded. Full details, including how to start a return, are in our Return Policy.

6. Health notice

Cigars are a tobacco product. Cigar smoking can cause cancers of the mouth and throat, even if you do not inhale, and is not a safe alternative to cigarettes. Tobacco smoke increases the risk of lung cancer and heart disease, even in nonsmokers. Our products are intended for adult consumers only and are not intended to help anyone quit smoking or for any medical purpose.

7. Your account and conduct

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You agree to provide accurate, current information and to update it as needed. You agree not to use the Site for any unlawful purpose; to purchase products on behalf of anyone under 21; to interfere with the Site’s operation or security; to scrape, copy, or reproduce Site content without permission; or to misrepresent your identity or age.

8. Intellectual property

The El Bombero name, logo, product designs, the Firefighter Call Box design, photographs, text, and all other content on the Site are owned by or licensed to El Bombero USA and are protected by trademark, copyright, and other laws. You may not use them without our prior written permission, except to view the Site and make purchases for personal use.

9. Promotions and communications

Promotional offers and discount codes are subject to their own stated terms, may not be combined unless we say otherwise, and may be modified or withdrawn at any time. By providing your email address or phone number, you agree to receive order-related messages. Marketing messages are sent only if you opt in, and you can unsubscribe at any time.

10. Disclaimer of warranties

The Site and all products are provided “as is” and “as available.” To the fullest extent permitted by law, El Bombero USA disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted or error-free. Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, El Bombero USA and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase or use of our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold harmless El Bombero USA from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law, including laws governing the purchase and use of tobacco products.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us first so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they were last revised. Changes apply to orders placed after the new Terms are posted. Your continued use of the Site after changes are posted means you accept the updated Terms.
